A&E Television Networks ("Sponsor"), NMA Entertainment & Marketing ("Administrator"), DNC Parks & Resorts at KSC, Inc., HobbyTown USA, Celestron, LLC, ("Promotion Partners"), and each of their respective parents, affiliates, subsidiaries, advertising and promotional agencies, prize providers, participating retail locations and each of their respective officers, directors, employees and members of the immediate family and persons living in the same household of each are ineligible. PROGRAM DESCRIPTION: The Sweepstakes begins at 12:00:01 AM Eastern Time (ET) on July 11, 2007 and ends at 11:59:59 PM (ET) on September 11, 2007 ("Promotion Period"). THE UNIVERSE airs Tuesday nights at 9:00 PM (ET) on The History Channel, with the first episode airing 5/29/07 and the last episode airing 9/4/07. After each week's episode during the Promotion Period, consumers will log on to History.com/universe to view an image about that week's episode and answer a "fill in the blank" question. A new "fill in the blank" question will be posted after each episode for one week and consumers are invited to return to the site each day to "fill in the blank" and be entered in the random drawing at the end of the sweepstakes. Only correct answers are eligible. For purposes of this Sweepstakes, a "week" is defined as beginning on Wednesday at 12:00:01 AM (ET) and ending on Tuesday at 11:59:59 PM (ET), except for the last week, which will run from Wednesday, August 29 at 12:00:01 AM (ET) to Tuesday, September 11 at 11:59:59 PM (ET).
HOW TO ENTER: Participants are invited to watch THE UNIVERSE on The History Channel, each Tuesday between July 10, 2007 and September 4, 2007, beginning at 9:00 PM (ET) and ending at 10:00 PM (ET). Check your local listings for correct channel, scheduling and possible pre-emption. In the event an episode is pre-empted, you may continue to enter the Sweepstakes by answering the "fill in the blank" question that appears on the site from the prior episode. You may only enter the Sweepstakes online. To enter, participants will visit http://www.History.com/universe during the Promotion Period where they will be instructed to complete an online registration form in order to play THE HISTORY CHANNEL "THE UNIVERSE: GET YOUR MIND BLOWN" SWEEPSTAKES "fill in the blank" game. Participants will see an image about that week's episode. Participant must correctly answer the "fill in the blank" question relating to that image. Each day a participant answers correctly, completes the online registration form (or logs in, if he/she has already completed the online registration form) and clicks on the "Submit" button during the Promotion Period, they will receive one (1) entry into the sweepstakes. For purposes of this Sweepstakes, a "day" shall be defined as a 24-hour period, beginning at 12:00:01 am ET and ending at 11:59:59 pm ET. Limit one (1) game play/entry per person, per email address, per day. Entries that have been generated by a script, macro, bot or any other automated means will be deemed void. Entries that are mechanically reproduced, copied, illegible, incomplete or inaccurate are void. Duplicate entries submitted by the same person or the same email address, on the same day are void. Proof of emailing does not constitute proof of receipt. By entering the Sweepstakes online, participants acknowledge that they are aware of and agree with the Sponsor's privacy policy located at: http://www.History.com/privacy/index.html. Sponsor is not responsible for malfunctions of electronic equipment, computer hardware, software, malfunctions of the entrant's email provider, lost, late, incomplete entries or entries not received in time for the drawing. Entries not containing the required information and entries in excess of the stated limit by the same person will be disqualified. Proof of delivery or receipt of entry will not be deemed by Sponsor (defined below) as proof of entry. Any attempted form of entry other than described herein is void. Sponsor is not responsible for problems downloading entries from the website or for any other technical problems related to website entries. Sponsor reserves the right to modify, suspend or terminate the Sweepstakes in the event that it becomes infected by a computer virus or is otherwise technically impaired or for any other reason that prevents the fair and lawful administration of the Sweepstakes, and award prizes from among all eligible entries received prior to cancellation or termination. If a dispute results as to the identity of an online entrant, it will be determined that the online entry was submitted by the authorized account holder of the email address from which the entry is made. For these purposes, the authorized account holder is the natural person assigned to an e-mail address by an Internet access provider, on-line service provider or other organization responsible for assigning email addresses or the domain associated with the submitted email address. Entries become the property of Sponsor and will not be returned. Normal Internet access and usage charges imposed by your online service will apply. Normal fees charged by your wireless service provider will apply. Participant agrees to look to such provider for pricing information and details. Wireless service may not be available in all areas. Online entries must be received no later than 11:59:59 PM (ET) on September 11, 2007.
WINNER SELECTION: Three (3) Grand Prize Winners, two (2) First Prize Winners and ten (10) Second Prize Winners will be selected in a random drawing conducted by Administrator on or about October 15, 2007, from among all eligible entries received by Administrator, an independent judging organization, whose decisions are final on all matters relating to this Sweepstakes. Winners will be notified by phone or express mail on or about October 22, 2007. As a condition of winning, Grand Prize Winners will be required to sign and return, within fourteen (14) days of notification, an Affidavit of Eligibility and Release from Liability ("Release") and a statement affirming the winner's grant of all rights in the submission and the right to use winner's name, likenesses (where legal), and entry in all media for promotional purposes to Sponsor and Promotion Partners solely in connection with this promotion and without additional compensation. Failure to return any documents within the time specified or failure to respond to notification attempts or return of any prize or prize notification as undeliverable will result in disqualification and selection of an alternate winner. All prizes will be awarded.
PRIZES AND ODDS OF WINNING: Three (3) Grand Prize Trips: A 4-Day/3-Night trip for two (2) to Kennedy Space Center Visitor Complex to visit the Shuttle Launch Experience attraction. Trip includes roundtrip coach class air transportation for two (2) from a major US airport of Sponsor's choice near winner's residence, hotel accommodations (double occupancy), rental car and two (2) admission tickets to Kennedy Space Center Visitor Complex and the Shuttle Launch Experience (Estimated Retail Value ("ERV"): $2,000 each). Two (2) First Prizes: A SkyScoutTM Personal Planetarium from Celestron® (ERV: $399 each). Ten (10) Second Prizes: A NexStar 60 SLT computerized telescope from Celestron® and a Fifty Dollar ($50) gift certificate from HobbyTown USA® (ERV: $329 each). Total ERV of all prizes: $10,088. Odds of winning depend on total number of eligible entries received. Grand Prize package does not include taxes, insurance, applicable fees, service charges, surcharges or passenger facility charges, personal expenses, gratuities, incidental charges, or any other items not specifically described in these Official Rules, and all expenses for any of the foregoing are the sole responsibility of the Grand Prize Winners. Grand Prize Winner and guest must travel together on the same flight itinerary, including the same departure date, destination and return date, and must possess valid ID in order to travel. No stopovers are permitted on tickets issued as a prize; if a stopover occurs, the prize will terminate at the stopover point and full fare will be charged for the remaining segments, including the return, of the trip. Sponsor is not liable for any expenses incurred as a consequence of a flight cancellation or flight delay. Schedules subject to change without notice. No extension or change of trip dates by Grand Prize Winner will be permitted. Trip is subject to air/ground travel availability and all other prize and travel restrictions, as applicable. The trip may not be combined with any other offer. If a travel companion is a resident of a jurisdiction that deems him/her to be a minor, he/she must be accompanied by his/her parent/legal guardian, and such person must pay his/her own expenses, unless deemed to be the winner or any other traveling companion. Grand Prize Winners' travel companions (or parent/legal guardian if a traveling companion is a minor) must sign and return a Release of Liability/Publicity Release (where legal) prior to the issuance of travel documents. Terms and conditions related to gift certificates apply. No transfer, substitution or cash equivalent for any prizes will be permitted, except at Sponsor's sole discretion due to prize unavailability for any reason, and only then for a prize of greater or equal value determined by Sponsor shall be allowed. If any part of a Grand Prize trip is unable to take place as planned, for any reason, including but not limited to, cancellation, scheduling conflicts or an event of force majeure, the remaining components of the prize will be awarded and Sponsor's obligation to the winner will be fulfilled, and no other additional compensation will be provided. Allow 4-6 weeks for delivery of merchandise prize. Limit one (1) prize per person per email address.
GENERAL: Sweepstakes is governed by the laws of the State of New York, with venue and jurisdiction in New York County, NY and all claims must be resolved in the courts located in New York County, NY. By entering, entrants/winners agree: (1) to release the Sponsor, Administrator and Promotion Partners ("Releasees") and their agents from any and all claims, injuries, liability, losses or damages of any kind, resulting, in whole or in part, directly or indirectly, from the awarding, delivery, acceptance, use, misuse, possession, loss or misdirection of any prize or participation in this Sweepstakes or in any activity or travel related thereto; (2) to be bound by the Official Rules; (3) that the decision of the Sponsor is final and binding on all matters relating to the Sweepstakes; (4) to the use of their names and likenesses for advertising and promotional purposes solely in connection with this promotion, in all media worldwide (including online) without additional compensation, except in TN and where otherwise prohibited by law; (5) that the prize(s) are awarded AS IS and WITHOUT WARRANTY OF ANY KIND, express or implied, (including without limitation any implied warranty of merchantability or fitness for a particular purpose) unless otherwise expressly granted by the prize manufacturer; and (6) that the Releasees are not responsible for any inability of any winner to accept or use any prize (or portion thereof) for any reason. Winners are responsible for all federal, state and local taxes. Grand Prize Winner will be issued an IRS 1099 tax form for the actual value of the prize. Sponsor, Administrator and Promotion Partners are not responsible for technical, hardware or software malfunctions, telephone failures of any kind, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or utilized in this Sweepstakes which may limit the ability to participate or by any human or technical error which may occur in the processing of the entries in this Sweepstakes. Caution: Any attempt by an entrant or any other individual to deliberately damage the website or any online service related to this Sweepstakes or undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek damages (including attorney's fees) from any such person to the fullest extent permitted by law, including criminal prosecution. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that or any other provision. Sponsor reserves the right to disqualify entrants who violate the rules or interfere with this Sweepstakes in any manner. If an entrant is disqualified, Sponsor reserves the right to terminate that entrant's eligibility to participate in the Sweepstakes. As permitted by law in accordance with the Sponsor's Privacy Policy, Sponsor may use information, which all entrants provide about themselves, to send them announcements about the Sponsor's products and programs via electronic and ordinary mail. An entry, except where prohibited by law, constitutes a grant of permission to the Sponsor or its agents to include winners' names on the http://www.History.com site and in connection with a Winners' List without further notice or without additional compensation.
